These Terms of Service ("Terms") govern your access to and use of makojima.com, Makojima accounts, and the public Model API (the "Service"). Makojima is the business that operates the Service. In these Terms, "Makojima," "we," "our," and "us" refer to that business.
Accepting These Terms
By accessing or using the Service, you agree to these Terms, our Privacy Policy, and the Acceptable Use Policy. If you do not agree, do not use the Service. If you use the Service for an organization, you represent that you are authorized to bind that organization, and "you" includes it.
These Terms apply only to features that Makojima actually makes available through the public Production Service. A prototype, plan, announcement, test, internal tool, or future-products page is not a promised feature, offer, or release date.
Eligibility
You must be at least 16 years old and legally able to enter into these Terms. If the law where you live requires a higher age or parental authorization for an online service, that rule also applies. You may not use the Service if applicable law prohibits it or if Makojima previously terminated your access for serious or repeated violations.
Accounts And Security
You must provide accurate account information, keep it current, protect your password, session, API keys, application credentials, two-factor authentication factors, recovery material, and one-time codes, and promptly notify us of suspected compromise. You may not share an account or credential in a way that defeats security, ownership, usage, or credit limits.
Two-factor authentication is strongly recommended but is not required merely to create or manage developer access. You remain responsible for activity performed with credentials you issue or approve unless the activity resulted from Makojima's failure to use reasonable security or applicable law provides otherwise. This responsibility does not waive Makojima's duties under these Terms or applicable law.
Revoke a compromised API key or connected application promptly. Changing or resetting your password disconnects approved applications, but separately managed API keys remain active until you revoke them or they expire. Makojima may require fresh authentication, email verification, or a recovery review for a security-sensitive account action.
The Service
The current Service includes public model information, account and security settings, Developer Access, API Activity, credit balances, and a public API for one or more qualified text-model releases. The available model list can be empty when a release, capacity, account permission, or safety control is unavailable.
The current release does not offer website Chat or Agent workspaces, training, fine-tuning, datasets, adapters, marketplace sales, creator earnings, customer Hugging Face imports, payments, subscriptions, automatic top-ups, speech, image, or video inference. Those areas require a separate public release before they become part of the Service.
We may add, change, limit, pause, or remove features. Availability may depend on account state, location, safety and usage limits, model qualification, capacity, upstream rights, and provider availability.
Developer Credentials And Applications
An account-wide API key authorizes the Model API according to the account's current access, models, credits, and limits. The complete secret is shown once. You choose its expiration when it is created. Rotation replaces the secret, and revocation stops it.
Sign In with Makojima lets an operator-registered application ask you to approve a stated permission bundle in the browser. The current Model Access permission covers minimal account identity, eligible models, credit balance, inference, and requests attributable to that application. It does not permit password changes, API-key management, account settings, purchases, publishing, training, or another application's requests.
Application access tokens are short-lived and can be renewed through a protected rotating refresh credential. Closing an application does not revoke it. You can revoke all installations of an application in Developer Access, and the application can revoke its own installation when you sign out there.
You must not publish, sell, share, embed, or transmit credentials except to a system you control and trust for the approved purpose. Public applications must follow their registered callback and permission contract. Makojima may revoke credentials or registrations that are insecure, misleading, abandoned, abusive, or outside their approved use.
Model Requests And Output
Model output is probabilistic and may be inaccurate, fabricated, biased, incomplete, offensive, or unsuitable even when it sounds confident. Evaluate important output and obtain qualified human review before using it for legal, tax, accounting, investment, medical, employment, credit, housing, education, or other consequential decisions. Output does not represent Makojima's views.
You may use output for lawful purposes subject to these Terms and third-party rights. Similar or identical output may be produced for other people. Makojima does not promise that output is unique, protectable, accurate, or free of third-party claims.
Each accepted request is associated with the verified account, credential type, model release, request identifiers, credit reservation, status, and actual settlement. Idempotency prevents the same accepted operation from being charged or run as different work under the same request ID. Cancellation is best effort. Work completed before cancellation can still use credits.
Credits And Usage
Trial Credits and Premium Credits are non-transferable, non-withdrawable service units. They are not money, stored value, property, or a promise of cash redemption. Trial Credits can be limited to eligible processing. Premium Credits can fund eligible processing and any future purchase operation only when Makojima actually offers that operation.
All credentials for an account share the same balances, reservations, concurrency, and usage limits. Creating another key or application connection does not multiply them. The Service may reserve estimated usage before work starts and settle actual recorded usage once after completion, cancellation, or failure.
Makojima does not currently offer public checkout, subscriptions, automatic top-ups, marketplace purchases, creator earnings, or payouts. A future offer will require its own displayed price, terms, tax and refund information, and activation before it is available.
Your Content
You retain whatever rights you have in prompts, feedback, and other material you submit ("Your Content"). You grant Makojima a limited, worldwide, non-exclusive license to host, copy, transmit, transform, and display Your Content as reasonably necessary to provide, secure, support, and operate the Service, comply with law, and enforce these Terms.
You represent that you have all rights and permissions needed to submit Your Content and that the permitted processing will not violate law, contract, confidentiality, or another person's rights. Do not submit secrets, regulated records, or third-party personal information unless you are authorized to do so and the Service expressly supports that use.
Model API request content and results are subject to the retention described in the Privacy Policy. The current Service does not use private Model API content to train a model. A future training option would require a separate prospective choice and would not apply retroactively merely because you used the API.
Acceptable Use
You must follow the Acceptable Use Policy. You may not compromise accounts or systems, bypass safety, ownership, credit, rate, capacity, or permission controls, introduce malware, overload or scrape the Service without permission, use it to harm or deceive, infringe rights, or attempt to obtain another person's credentials, data, requests, results, prompts, models, or infrastructure details.
Makojima Content And Intellectual Property
The Service, sleeping-cats mark, interface, software, source organization, graphics, documentation, and other Makojima-provided content are owned by Makojima or the applicable licensors and protected by intellectual-property laws. Model names, weights, output, and related materials can be subject to separate upstream licenses and rights.
Except for the limited right to use the Service under these Terms, no rights are transferred to you. You may not copy, sell, sublicense, publicly distribute, remove notices from, or create a competing service from Makojima content except as permitted by law, an applicable license, or written permission.
Copyright complaints may be sent under the Copyright and DMCA Policy.
Communications
Makojima may send essential account and security messages, including email verification, sign-in, password, recovery, credential, policy, service, legal, and incident notices. These messages are necessary to administer the account or request and are not marketing.
The current Service does not offer optional marketing or personalized study email controls. Electronic messages and records satisfy written-notice requirements to the extent permitted by law. Keep your account email current.
Third-Party Services And Links
The Service depends on third-party hosting, authentication, database, storage, edge delivery, GPU infrastructure, monitoring, and email services. Third parties control their own services, terms, privacy practices, availability, and content. A link or integration is not an endorsement.
Makojima gives customer credentials only to the Makojima authorization boundary. Customer credentials do not become cloud, database-administrator, controller, or GPU-provider credentials. The Privacy Policy explains the service providers used for the current release.
Suspension And Termination
You may stop using the Service at any time and may request account deletion through Settings. Deletion removes ordinary account access and begins the applicable restricted-retention and purge process. It does not erase records that must be kept for security, disputes, legal holds, or other legal obligations.
Makojima may limit, suspend, or terminate access, credentials, requests, or accounts to protect the Service or others; enforce these Terms; respond to fraud, compromise, nonpayment, sanctions, legal process, or rights complaints; or address serious or repeated violations. Where practical and lawful, we will provide notice and a way to contact us about the decision.
Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available." Makojima disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, security, and accuracy. We do not warrant that the Service or model output will meet your requirements, be error-free, preserve every submission, or produce a particular result.
Nothing in these Terms excludes a warranty, remedy, or duty that cannot lawfully be excluded.
Limitation Of Liability
To the maximum extent permitted by law, Makojima and its officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption arising from the Service.
To the maximum extent permitted by law, Makojima's aggregate liability arising from the Service will not exceed the greater of 100 U.S. dollars or the amount you paid Makojima for the Service during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited or to liability that cannot lawfully be limited.
Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless Makojima and its officers, employees, contractors, and licensors from third-party claims arising from Your Content, your unlawful use of the Service, or your material violation of these Terms or another person's rights. This obligation does not apply to the extent a claim was caused by Makojima's own conduct or where applicable law prohibits it.
Governing Law And Disputes
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules, except where mandatory consumer law requires another result. Before filing a claim, contact legal@makojima.com and allow 30 days for an informal attempt to resolve it. If it remains unresolved, courts with jurisdiction in Washington will have exclusive jurisdiction unless applicable law requires another forum.
Changes To These Terms
We may update these Terms. If a change materially reduces your rights or expands how we use Your Content, we will provide reasonable advance notice when required and ask for renewed agreement when appropriate. The displayed effective date identifies the current version.
General Terms
If part of these Terms is unenforceable, the remaining parts remain effective and the affected part will be enforced to the maximum lawful extent. A failure to enforce a provision is not a waiver. You may not assign these Terms without written permission. Makojima may assign them in connection with a merger, acquisition, reorganization, or sale of the Service, subject to applicable law.
These Terms, the Privacy Policy, and the Acceptable Use Policy are the agreement for the current Service unless a separately accepted written agreement applies. Headings are for convenience. "Including" means including without limitation.
